Hi, I am a freelance photographer in Pennsylvania, USA. I shoot for a local newspaper as a 'stringer'. When I go to an assignment I usually shoot more photos then needed and I am paid on publication. Recently this paper began a new photo sharing site on their website. What they are doing is using 1-2 photos in the paper (hard copy) and placing the rest in a folder in the photo sharing website. On their website the photos can be viewed or purchased.
This is where the controversy comes in. To me- if the photos are used on the website and people can view and purchase the photos, this constitutes 'using the photos' and I feel I should be paid.
They don't see it that way.
What do you think and can something be done?
thanks for viewing,
Matt

At the very least you should be getting a royalty % per photo that they sell, but you're also well within your rights to demand your images be removed from their 'pay site' as it constitutes an infringement of your copyright.
Good luck. :happyCGI Specialist -

Unless they can produce documentation that states they own the copyright, they are stuffed.
I would definately speak to someone.
Hope this helps
