Problem with Client

Hi People,
I'm new here - so hello there :)
I'm having a problem with a current client which i'm not sure about and would appreciate any advice you can give.
I have worked for this client (the agency), who is a development agency, since last year as a freelancer on various projects. The contentious area is with one of their clients (their customer) who have commissioned work with the agency.
I have never signed a contract with the agency and was hired to develop the system for their customer.
I have asked for support right from the beginning with regards to account management which has never materialised. And as such their customer has constantly shifted specifications and requirements for their project which was originally scheduled to take 3 months but once we started a new specification which was much more substantial was issued by their customer.
I have not been paid for this project since June (but have undertaken another project with the agency which i have been paid for) but prior to that i had been paid monthly for this project. Now comes the contention. Their customer is expecting delivery of the project now but the agency is refusing to pay me the last invoice for the other project i was working on with them until i deliver the final code for their customers project. I am naturally refusing to do anymore work for them until invoices are brought up to date.
In addition to this i have been asking for clarification from their customer in aspects of system functionality which has never been supplied.
Now their customer is threatening legal action to them and i'm concerned about the repercussions to me since i have no contract and the final project has not been delivered.

Messages count : 87Likes count : 3Registration : 4 February 2008Without going into the rights and wrongs of the invoice payments (other people on this forum are much more qualified in that respect) I'd suggest trying to get face to face meetings with a representative of the agency and the client. You may have already done this, but if you haven't done so it may be worthwhile – it's in everyone's interests to resolve the problems and get the job delivered. Face to face meetings can be much more productive and result in far more agreement than firing emails back and forth – communication is key to getting this sort of thing settled.Opus Creative Design Ltd -

You would be surprised by the amount of freelancers who would agree and "hope everything works out for the best".... :eek2
Don't worry overly with regards to the impending legal action, you will have no financial liability should the end client win any case. However this legal action will undoubtedly impact on your relationship with the agency and also the agency's cash flow we imagine...
